Dear Ms. Warren,
Thank you for your letter [see below] concerning the above complaint received tonight July 1, 2025 at 7:17 pm - you're working late!
Your letter is clear on your adverse decision. No disagreement with your statement, although NC credit union law § 54-109.12. [link] states exactly the opposite.
I must ask for a brief clarification on the statement in your last paragraph which reads:
"Our agency does not interfere with a board of directors’ business decisions that are not in violation of laws and/or rules under our authority."
Would ask that you reconfirm that requiring a credit union to comply with its bylaws does fall within the "laws and/or rules under our authority."

bylaws, would be happy to accept your decision and consider this matter

The judgment here, exactly as expected, is that neither bylaws nor any election procedure notification requirements were violated. Her statement simply says when that doesn’t occur, they don’t get involved. She didn’t say they don’t have jurisdiction over bylaws.
ReplyDeleteEither way, surely you realize your acceptance of their decision is not required. They could give a rip whether you accept it or not. Wouldn’t hold my breath on a another response, either. It’d be disappointing to see them waste more time on you. Case closed.
Told ya exactly how this was going to play out. Either you were too stupid to come to the same conclusion given the plain language in the procedures, or you knew all along there was no formal change in procedures, but threw up your smokescreen just to try to make the board look bad. You come off looking ridiculous either way. And yes, it can get worse if you keep belaboring this.
I say take your ball and go home. You got beat. Badly.
